Wayne Taylor and Anne Landrum obtained an order from the United States District Court for the Northern District of Florida on behalf of Landmark American Insurance Company, granting its motion to dismiss. The case involved a claim by the owners of restaurants in Florida and Alabama for loss of business income they claim they suffered when civil authorities ordered all non-essential businesses to close or modify their operations to help prevent the spread of the Coronavirus. The court ruled that “economic losses resulting from state and local governmental orders closing businesses to slow the spread of COVID-19 are not covered under [an ‘all-risk’ policy] because such losses were not caused by the direct physical loss of or damage to the insured property.”
